商标法“公共利益”意涵的界定与适用

摘要 “公共利益”已经成为商标法“不良影响”条款的核心内容,然而对于这一概念仍然缺乏正本清源的梳理与具体适用的指引。公共利益受益对象的不特定性是其区别于集体利益的根本要素。现有法律体系中存在公共利益与公共秩序的混用,但实际上二者是同一的。司法实践中存在错误适用“不良影响”条款规制公共符号、不规范使用汉字和不文明用语商标的情形。在具体适用时,应当注意区分集体利益与公共利益;关注行政法基本原则在此的适用;商标作为市场经济的重要元素,法律规制也应依照国际竞争适当宽松。唯有如此,才兼顾公共利益的本来含义,同时回应《商标法》对“不良影响”条款的期待。 The public interest has become the core content of the“adverse effects”clause in the trademark law.However,there is still a lack of sorting out the original of this concept,as well as guidance on application.The indeterminacy of the beneficiaries of public interest is the fundamental factor that distinguishes them from the collective interest.There is a mixture of public interest and public order in our legal system,but in fact they are the same.In the judicial practice of our country,there are some cases in which the“adverse effects”clause is wrongly applied to regulate public symbols,and the use of Chinese characters and trademarks of uncivilized terms is not standardized.In the specific application,attention should be paid to distinguish between collective interests and public interests;concerned about the application of the basic principles of administrative law;as an important element of market economy,the legal regulations should be eased according to international competition.Only in this way can the original meaning of public interest be taken into account,while responding to the expectation of“adverse effects”clause in trademark law.
