摘要
近年来我国离婚率显著上升,《民法典》第1077条之设立是对于我国离婚现状的积极回应,该制度的设立没有限制当事人的离婚自由,但不宜针对所有离婚案件统一适用。在离婚冷静期制度设立的同时,应构建相应的配套措施。灵活的调解制度、专业的家事调查员制度和家庭法庭的设立,均有利于离婚纠纷的解决。
In recent years,the divorce rate in our country has increased significantly.The establishment of Article 1077 of the Civil Code is a positive response to the current divorce situation in our country.The establishment of this system does not restrict the parties'freedom of divorce,but it is not suitable for uniform application to all divorce cases.When the divorce cooling-off period system is established,corresponding supporting measures should be constructed.A flexible mediation system,a professional family investigator system and the establishment of a family court are all conducive to the settlement of divorce disputes.
