摘要
在新冠肺炎疫情所引发的“整体性危机”之下,欧洲人权法院面临着如何调节一国基于社会治理复杂性所享有的边际裁量余地,与保障个人权利的强烈义务之间的巨大压力。尤其是在风险社会与紧急状态的相互交织中,防控措施走向“半政治中心化”状态。这就不可避免地会使人们担心后疫情时代的欧洲人权法院在法律与政治的双重因素之间“钟摆”。但危机之中,也蕴含着机遇。在欧洲人权法院的既有体系中,引领性判决程序、通知义务,以及第15号议定书仍需要进一步变革,从而完善欧洲人权保障体系。
Under the“integrity crisis”caused by the COVID-19,the European Court of Human Rights is facing great pressure between how to adjust the margin of appreciation that a country enjoys based on the complexity of social governance and the strong obligation to protect individual rights.Especially in the interweaving of the risk society and the state of emergency,the prevention and control measures are moving towards a“semi-political centralization”state.This inevitably makes people worry that the European Court of Human Rights in the post-epidemic era“pendulums”between the dual factors of law and politics.But in the crisis,there are opportunities.In the existing system of the European Court of Human Rights,the pilot judgment procedure,notification obligation,and Protocol No.15 still require further changes to improve the European human rights protection system.
