摘要
作为全球“引资大国”和“投资大国”,中国参与国际投资的规模不断扩大、程度不断加深,对外签订的投资规则也在不断拓展和深化。文章首先全面梳理了中国对外签订投资规则的发展历程;其次,从投资规则的演化和提升视角,针对中国自贸协定中投资规则的两个版本1.0和2.0,分析了不同版本的法律框架与核心条款。最后,立足于后疫情时代的现实背景,认为中国应对标国际高标准投资规则,结合自身特点和需求,逐步迈进自贸协定投资规则版本3.0,实现中国新一代自贸协定投资规则的升级。
As the world's major“investment host country”and"investment home country",China's partici-pation in international investment activities as well as its signed investment rules have been expanding and deepe-ning.This article comprehensively summarizes the process of signing investment rules by China,and then divides the investment rules in China's free trade agreements into versions 1.0 and 2.0 and analyzes the evolution of legal framework and core clauses of different versions.Further,this article suggests that China should make reference to international high-standard investment rules,and gradually step up to version 3.0 of investment rules in free trade agreements in consideration of its own characteristics and needs,so as to realize the upgrading of China's new gen-eration of investment rules in the post COVID-19 era.
