摘要
以非法侵害违章建筑造成的财产损害赔偿纠纷为例,阐明违章建筑的界定和行政纠纷案情,分析行政案例裁判要旨,讨论拆除违章建筑的行政强制执行主体,为建设项目环境影响评价审批工作提供借鉴。
Taking the property damage compensation dispute caused by illegal infringement of illegal construction as an example,this paper expounds the definition of illegal construction and the case of administrative dispute,analyses the gist of administrative case judgment,discusses the administrative compulsory enforcement subject of demolishing illegal construction,and provides reference for the approval of environmental impact assessment of construction projects.
