摘要
变通立法是我国社会主义法律体系和民族区域自治制度实践的共同产物。《宪法》《民族区域自治法》和《立法法》为变通立法提供了规范依据;《刑法》《民法通则》等12部法律法规亦先后授权民族自治地方制定变通规定。这两者构成了变通立法的双重效力来源,交织成"复线"。"复线"之下的变通立法,在国家法的普遍性与民族地区的多样性之间建起桥梁,以变求通,既维护法律法规体系的统一、又因地制宜推进民族事务治理的法治化,发挥其"小而必要"的作用。随着全面依法治国战略的深化,"复线"持续整合,回归"基线";变通立法也因应当地民族的政治、经济、文化特点在数量内容上出现新动向,以通促变,在优化自身的同时为完善我国社会主义法律体系和民族区域自治制度贡献宝贵经验。
Flexible legislation is the double off spring of Chinese socialist legal system and minority regional autonomy system.The Constitution,Law on Regional National Autonomy and Law on Legislation provide a normative basis for fl exible legislation,and 12 Laws and regulations,such as Criminal Law and General Provisions of Civil Law,also authorize the minority autonomous regions to make the fl exible acts,which constitutes the sources of dual eff ectiveness of fl exible legislative system.The fl exible legislation based on such multiple relations builds a bridge between the universality of national laws and the diversity of ethnic regions,which not only maintains the unity of the laws and regulations,but also promotes the rule of law in the governance of ethnic aff airs in accordance with local conditions,playing its small but necessary role.With the deepening of strategy of"comprehensive the rule of law",the sources of eff ectiveness integrate.The flexible legislation turns the new tendency of the quantity and content according to local political,economic and cultural characteristics.The"Alternation"and"Evolution"of fl exible Legislation provides the irreplaceable experience for the improvement of Chinese socialist legal system and ethnic regional autonomy system.
