水资源所有权行使主体权责研究

摘要 水资源所有权行使主体包括代表行使主体即自然资源部,以及代理行使主体即中央委托授权的地方政府、相关部门。从纵向层面看,不同层级水资源所有权行使主体权责高度同质化,事权划分上下一般粗;从横向层面看,同一层级水资源所有权行使主体权责划分模糊混乱,职能配置交叉重叠。为解决纵向主体权责划分重合以及横向主体权责交叉等问题,必须明确划分水资源所有权行使主体的权责,建议建立健全事权划分法律规范,细化纵向主体与横向主体的权责,利用"协调+最终决策"机制解决主体间权力冲突,同时正名流域管理机构在水资源综合治理中的主导地位。 The exercise subject of water ownership includes the representative exercise subject,the ministry of natural resources and the local government and relevant departments acting as agent and entrusted and authorized by the central government.From a vertical perspective,the ownership of water resources at different levels is highly homogenous,and the division of rights is generally rough;from a horizontal perspective,the division of the main rights and responsibilities of the ownership of water resources at the same level is fuzzy and chaotic,and the allocation of functions overlaps.In order to solve the problems of overlapping of the division of rights and responsibilities of vertical subjects and the overlapping of rights and responsibilities of horizontal subjects,it is necessary to clearly divide the rights and responsibilities of the subjects exercising the ownership of water resources.It is recommended to establish and improve the legal norms for the division of rights to refine the rights and responsibilities of vertical subjects and horizontal subjects.The“coordination+final decision-making”mechanism resolves the right conflicts between the subjects,and at the same time rectifies the dominant position of river basin management agencies in comprehensive water resources management.
