摘要
推进司法管理体制改革重在“深化”“综合”“配套”。其路径选择在于,全面客观评估第三轮司法管理体制“历时性”改革成效,在对其存在的改革项目清单“悬空”等“若干短板”“薄弱环节”精准检视的基础上,从深化司法体制综合配套“共时性”改革出发,发展完善相对独立、协调统一的司法管理体系,结构科学、功能完善的办案组织体系,系统完善、科学合理的司法职能体系,权责统一、规范有序的司法权运行体系,综合配套、机制健全的司法财物保障体系,激励约束、严密规范的司法监督体系,从而加快推进司法管理体系和司法管理能力现代化。
To promote the reform of the judicial management system,we should focus on how to deepen it,how to be comprehensive and how to build supporting system.The choice of its path lies in the comprehensive and objective evaluation of the third round of"diachronic"reform of the judicial management system,on the basis of the accurate inspection of the"short boards","weak links"of the"suspended"list of reform projects.To start with the central government's projects related to deepening the"synchronic"reform of the judicial management system,we should develop and improve the relatively independent,coordinated and unified judiciary management system.We should form a scientific and fully functional handling organization system;We should establish the organization system of handling cases with scientific structure and perfect function and the judicial function system with perfect system and scientific rationality.We should establish a unified,standardized and orderly judicial power operation system,a comprehensive supporting and mechanism sound judicial property security system,and a judicial supervision system with strong incentive.So as to accelerate the modernization of judicial management system and judicial management capacity.
