摘要
示范诉讼在化解重大突发事件引发的群体性纠纷中具有深化诉源治理、提升审判能力的突出效果。我国当前的示范诉讼实践在制度功能、适用范围、案件选定、审理程序、示范判决效力扩张、文书样式等方面标准不一。基于不同的诉讼文化背景,国外的相关制度具有“以讼励讼”的功能导向,我国相关制度呈现出“以讼止讼”的功能导向。为了使示范诉讼在本土诉讼文化背景下达成提高审判质效和保障当事人诉权的平衡,应当从诉源治理出发重新定位制度功能,确立示范案件的选择标准,设立程序异议的中间裁定,设置繁简分流的审理程序和文书样式,优化诉讼服务与公共法律服务对接机制,充分发挥示范诉讼源头化解重大突发社会矛盾风险的效果。
Model litigation has outstanding effects in resolving group disputes caused by major emergencies,such as deepening the governance of litigation sources and improving the ability of trial.China’s current model litigation practice has different standards in terms of system function,scope of application,case selection,trial procedure,expansion of model judgment effectiveness,and document style.Based on different litigation cultural backgrounds,foreign related systems have the functional orientation of“encouraging litigation with litigation”,while our related systems show the functional orientation of“stopping litigation with litigation”.In order to achieve a balance between improving the trial quality and ensuring the litigious right in the context of China's litigation culture,we should reposition the system function from the perspective of litigation source governance,establish the selection criteria of demonstration cases,set up intermediate adjudication of procedural objections,set up trial procedures and document styles that distinguish between complex and simple procedures,optimize the docking mechanism between litigation service and public legal service,and give full play to the effect of resolving the risk of major sudden social contradictions at the source of model litigation.
