摘要
近年来政府信息公开领域呈现出权利异化、申请泛滥的态势。规制政府信息获取权滥用可从禁止权利滥用原则推导而出,且具有宪法层级的正当依据。2019年修订后的《政府信息公开条例》是程序弹性模式和制度规制模式的结合,配置了合理描述、延长期限、收取费用、主动公开转化等机制,其第35条将数量、频次明显超过合理范围的滥用类型直接引入信息公开法律规制体系中,具有进步意义,但是在实践中仍然存在合理性界定、裁量权控制的问题。
In recent years,there has been a trend of abuse of rights and widespread applications in the field of government information disclosure.Regulating the abuse of government information access can be derived from the principle of prohibiting abuse of rights,which has a legitimate basis at the constitutional level.The revised Open Government Information Regulation in 2019 is a combination of a procedural flexibility model and a system regulation model,which set up some mechanisms such as reasonable description,extension of time limit,collection of fees,and active transformation.Article 35 in it directly introduces the types of abuse whose quantity and frequency obviously exceed the reasonable range into the information disclosure legal regulation system,which is of progressive significance,but there are still problems of definition of rationality and control of discretion.
