摘要
学校体育法律法规体系问题引起了学界的广泛关注,其中对现行学校体育法律法规体系构建的研究,从微观层面揭示了其在立法、执法、守法和监督层面的问题。研究认为:构建属于动词,主要针对“立法”领域,不应涉及到执法、守法和监督等运行层面。针对我国学校体育法律法规体系的构建,应该注重明确学校体育法律法规体系的基本架构、学校体育法律法规体系现存在的突出特征和学校体育法律体系构建的可能路径等三个核心议题。基于以上认识,对我国学校体育法律法规体系的构建进行探索,以期与学界朋友商讨。
OAs issue involved with the legal system governing school sports has aroused widespread concern in academic circles, the research on the establishement of laws and regulations system for school sports reveals the legislation and enforcement of law and supervision issues, from the micro level. The study concluded that the construction of a verb, mainly for the "legislative" areas, should not be involved in law enforcement, law enforcement and supervision, and other operational levels. To establish the system of school sports education of China’s laws and regulations, three core issues should be solved, including building the basic architecture of school sports legal system, the features of such legal system, and the possible approach of establishing such legal system. Based on the above understanding, the author explored the establishment of school sports laws and regulations in China, with a view to discussing with friends in the academic circle.
