摘要
在检察办案责任制改革和捕诉一体改革背景下,案件质量评价制度对于规范和监督检察权运行的价值日益凸显.与既往业务评价指标相比,"案-件比"指标对案件评价的质量、效率、效果维度,分别实现了"结果导向"到"过程导向","办案量控制"到"非必要程序控制","单一内部视角"到"当事人视角"等评价模式的转变,对检察内部程序的规范化和检察引导侦查的主动性有正向促进作用.为防止"案-件比"指标体系的运行走入误区,有必要平衡"单个指标与指标体系""指标统一化与标准差异化""整体质效与个体责任""指标数据与办案实效"等四个层面的关系,发挥"案-件比"指标的协同作用,针对不同类型案件确立差异化的评价基准,实现指标评价与个案评查的机制衔接,并完成数据管理到实质管理的进阶.
In the context of reform of procurator responsibility system and the unity of decisionmakers of arrest and prosecution,the evaluation system of case quality for regulating and supervising the operation of procuratorial power has become more significant.Compared with previous evaluation indicators,the“case-process ratio”indicator has transformed the evaluation mode of the quality,efficiency,and effect,respectively,from“outcome-oriented”to“process-oriented”,“case volume incentive”to“unnecessary process control”and“internal perspective”to“external perspective”.This logical change is conducive to enhancing the standardization of procuratorial procedures and procurators9 initiative to guide investigations.In order to avoid the dilemma of the“case-process ratio”index system in practice,the procuratorate needs to well balance relationships such as“the single index and the entire index system”,“the unification and differentiation of index”,“the overall quality and the individual responsibility”,and“the statistics and the effects of case-handling”.Moreover,it is essential to improve the synergistic role of“case-process ratio”index,to establish appropriate standards for different types of cases,to coordinate the system of“case-process ratio”with the case-quality examination mechanism,as well as to change the evaluative methods from“numerical management”to“substantial management”.
