摘要
义绝作为中国古代法定离婚制度之一,指由于夫妻双方或两方家族一定范围内亲属实施了某类特定行为,官府认为已导致夫妻之间恩义断绝,因而判决夫妻强制离婚。其思想雏形滥觞于汉代,至唐时作为一项法律制度正式入律,后经过历朝历代不断沿袭革新,直至清末修律始被废除。以义绝之嬗变历程为线索路径,在充分运用《唐律疏议》《元典章》《大清律辑注》等史料文献基础上,对这一制度的实质内涵与现实价值进行系统考察。适逢《中华人民共和国民法典》正式颁布,其中有关离婚的规定引起社会广泛讨论。通过解读古代之义绝,以期为当代之婚姻法平衡婚姻自由与道德人伦之间关系提供一种新视角。
Yijue,as one of the legal divorce system in ancient China,means that as a result of some certain kind of specific behavior committed between a couple or their relatives within a certain range of the two families,the government judges that the relationship between husband and wife was broken off,therefore they are forced to divorce.The embryonic form of the thought originated in the Han dynasty,formally adopted as a legal system in the Tang Dynasty,and then continued to follow and innovate through successive dynasties,until the law revision at end of the Qing Dynasty was it formally abolished.Taking the course of the historical evolution of Yijue as a clue,and on the basis of making full use of the historical documents such as Discussion on Tang Law,Yuan Dian Zhang,Annotations to the Qing Dynasty,this paper makes a systematic investigation on the essential connotation and practical value of Yijue.Recently,the Civil Code of the People’s Republic of China has been formally promulgated,in which the provisions on divorce have aroused extensive discussion in the society.Through the interpretation of the ancient Yijue,the paper hopes to provide a new perspective for the contemporary marriage law to balance the relationship between freedom of marriage and moral ethics.
