摘要
作为新经济的发展引擎,网络平台以信息和资源连接者和整合者的身份,深入社会生活各方面,同时也导致平台经营者侵权案件层出不穷。理论上,安全保障义务延伸至网络空间,从风险控制、成本收益一致、信赖利益保护角度以及社会发展变化等方面都具有一定正当理由。认定安全保障义务的具体内容,应根据平台提供服务的类型、所获利益以及监管成本等因素,合理确定边界。实务中,应协调安全保障义务与相关法条的适用,以个案分析明确其具体责任类型。
Working as the engine of new economy,nework platform has,as the linker and integrator of information and resources,involved various aspects of social life and caused many infringement cases cimmitted by network platform operators.Theoretically,the security obligation extended to network space is resonable because of risk control,cost-benefit consistency,trust interest protection,development and changes of the society,etc.In order to define concrete content of security obligation,we shuld take the following elements as basis,including the types of service provided on network platforms,benefits gained,and supervision cost,etc,so as to make a clear definition.In practice,we should coordinate security obligation and the application of related laws and regulations,and clarify concrete types of responsibilities through alalysis on individual cases.
