摘要
随着司法体制改革带来的司法权力扩增,司法权的监督成为重点。当前,司法责任制带有结果主义导向误区,传统监督机制功能日趋虚化。大数据则为司法权的监督提供了新路径,体现为基于数据采集的实时监督机制,基于数据画像的业绩考核机制,基于知识图谱的证据审查机制以及基于法律推理的偏离度预警机制。大数据司法监督具有全景式监督、预防性监督及算法监督的特征。同时,要注意大数据司法监督中的数据风险和算法风险,防止"监督"演化为"监控",防范大数据对司法裁判权的过度干预。
With the expansion of judicial power brought by judicial system reform,how to supervise the judicial power has become the main issue.Nowadays,judicial responsibility system has the results-oriented mistake,and the function of traditional judicial supervision system has been deteriorated.However,big data have provided a new way for judicial supervision,which includes the real-time supervision system based on data acquisition,the performance evaluation of data profiling,the evidence examination of knowledge graph and the degree of sentencing deviation based on legal reasoning model.Big data judicial supervision system has the features of panorama,the predictive supervision and the algorithm supervision.It is also necessary to pay attention to the risk of data and algorithm,as well as to prevent the big data monitoring and the excessive interference to judicial power from big data.
