摘要
协同治理是流域水污染治理的必由之路,实现协同立法是流域协同治理的首要前提。当前,海河流域水污染治理中国家层面法律法规、地方层面法规以及地方标准的不协同制约着流域协同治理的开展。其中,“顶层设计”的缺失、地方治理投入差距大以及流域外部性的本质特征是立法不协同的主要原因。海河流域应发挥领导组织的立法协调主动性,建立常态化的立法协商机制和法规条文清理机制,适时制定《海河流域水污染管理条例》并推行“契约性”立法,以促进流域有效协同治理,早日实现生态美好。
Collaborative governance is the shortcut of river basin water pollution control,and collaborative legislation is the primary premise of river basin collaborative governance.At present,the non coordination of national laws and regulations,local laws and regulations and local standards restricts the development of collaborative governance of water pollution in Haihe River Basin.Among them,the lack of“top-level design”,the large gap of local governance investment and the essential characteristics of basin externality are the main reasons for the non coordination of legislation.The Haihe River Basin should give full play to the initiative of Legislative Coordination of leading organizations,establish a normalized legislative consultation mechanism and a mechanism for clearing the provisions of laws and regulations,timely formulate the“Regulations on water pollution management of the Haihe River Basin”and implement the“contractual”legislation,so as to promote the effective collaborative governance of the basin and realize the beautiful ecology as soon as possible.
