摘要
我国《民法典》将人格权独立成编并纳入人格权请求权制度,从立法层面对学界争论已久的人格权的地位及人格权请求权在民事权利体系中的定位做出回应。人格权请求权独特的性质、侧重于事前预防的救济目的及其与侵权损害赔偿请求权的区别,决定了人格权请求权在民事权利体系中的独立定位。但我国《民法典》尚未明确人格权请求权的种类,司法适用上的困境依然未解。根据人格权请求权的性质和立法目的,人格权请求权的种类应当仅包括具有预防目的的停止侵害、排除妨碍和消除危险。此外,我国《民法典》针对具体人格权对人格权请求权做出细化规定,引入诉前禁令、更正删除请求权等具体的人格权请求权,构建了完善的人格权请求权体系,有利于人格权的周全保护。
In the Civil Code of China,the personality right is independently compiled and included into the system of claim of the personality right,which responds to the long debated issues of the position of the personality right and the claim of personality right in the system of civil rights at the legislative level.The three factors determine the independent position of the claim of the personality right in the system of civil rights—the unique nature of the claim of personality right,the emphasis on the relief of ex-ante prevention and the difference between the claim of the personality right and the right to claim damages in tort.However,in China’s Civil Code,the types of the claim of personality right have not clearly been defined,and therefore the judicial application is still unsolved.According to the nature and legislative purpose of the claim of the personality right,the claim of the personality right should include ceasing the infringement,eliminating the obstruction and the danger,all of which are preventive.Furthermore,detailed provisions on the claim of the personality right have been laid down in the Civil Code with the specific personality rights as a reference;such specific claims of the personality right as the right of injunction before litigation and the right to correct the deletion should be introduced to construct a perfect system of the claim of the personality right,which are conducive to the comprehensive protection of the personality right.
