摘要
当前,新精神活性物质问题是全球禁毒领域的热点和难点问题。中美两国新精神活性物质问题的现状存在不同的特点。通过对中美两国新精神活性物质在认定方式、预警机制、列管标准、列管程序及后续司法处置等方面的比较研究,从预警机制建设,建立具有中国特色的临时列管制度,完善已列管新精神活性物质量刑标准,三个方面提出进一步优化我国对新精神活性物质管制模式的建议。
At present, the issue of new psychoactive substances(NPS) is a hot and difficult issue in the field of global drug control. The present situation of the issue of new psychoactive substances in China and America has different characteristics. Through a comparative study of the Identification Methods, early-warning mechanism, listing standards, listing procedures and subsequent judicial disposal of new psychoactive substances in China and the United States, from the perspective of early-warning mechanism construction, in order to perfect the quality standard of new fine and living materials, the author puts forward three suggestions to further optimize the control mode of new fine and living materials in China.
