摘要
根据中英两国案例和《中华人民共和国海商法》《中华人民共和国民法典》,将国际海上货物运输纠纷中一些涉及留置权的问题从理论上予以提炼,研究第三人海商留置权的存在及其表现形式,得出其构成要素和效力原则。共列出第三人海商留置权四类十四种情形,其中一部分通过典型的第三人留置权案例推出。在部分构成第三人海商留置权但无法认定其效力的案例中,法院应按照穷尽法律手段最终解决争议的原则,运用确权的方式将双方当事人的利益再分配,而不能将案件推出裁判范围。
This paper is to clarify the various ways to form the possessory liens on maritime property of a third party and their legal effects from the arguments in the international carriage of goods by sea,based on the cases of China and the U.K.as well as the Chinese Maritime Code and the Civil Code of the People’s Republic of China.The author has discovered 14 kinds of such liens that can be divided into 4 groups,and believed that they should not be pushed out of the jurisdiction even though they are of no legal effects,rather,the interests of both parties should be re-determined.
