摘要
突发公共卫生事件中公权力行为附随效果致损的补偿是我国卫生应急工作中不容忽视的一个重要环节,这项工作将直接影响到灾后社会生产、生活秩序的恢复。结合我国现行行政补偿现状,对当前突发公共卫生事件中有关合法公权力行为附随效果致损产生的补偿问题进行分析,探索和研究出适合我国国情的行政补偿机制与补偿方法。
The compensation for the damage caused by public power behavior in public health emergencies is an impor⁃tant link that can’t be ignored in China’s health emergency work.The completion of this work will directly affect the re⁃covery of social production and life order after the disaster.Combined with the current situation of administrative compen⁃sation in China,the paper analyzes the compensation problems caused by the collateral effect of legal public power be⁃havior in the current public health emergencies,and explores and studies the administrative compensation mechanism and compensation methods,which are suitable for China’s national conditions.
