摘要
党的十八大以来,党内法规和国家法律之间的关系成为中国共产党加强制度建设的一个核心课题,而纪法关系则是处理党规国法关系无法避开的问题。作为党的纪律建设成果集中体现的《中国共产党纪律处分条例》历经三年两次修改,在充分吸收《中华人民共和国监察法》等相关法律精神的基础上,成功地将党的十八大以来中国共产党关于纪法关系处理的最新成果融入其中,具体体现为纪法分开、纪在法前、纪严于法、纪法贯通四个方面,对于新时代坚持依规治党和依法治国有机统一具有重大意义。
Since the 18 th National Congress of the Communist Party of China,the relationship between Party regulations and national laws has become a core issue for the Communist Party of China to strengthen the system construction,and the relationship between discipline and law is an issue that cannot be avoided in dealing with the relationship between Party regulations and national laws.As the concentrated embodiment of the Party’s discipline construction achievements,the Regulations on Disciplinary Punishments of the CPC has been revised twice in three years.On the basis of fully absorbing the spirit of the Supervision Law of the People’s Republic of China and other relevant laws,it successfully integrates the latest achievements of the Communist Party of China in dealing with the relationship between discipline and law since the 18 th National Congress of the Communist Party of China,which is reflected in four aspects:separation of discipline and law,discipline before law,discipline stricter than law,and discipline through law.It is of great significance to adhere to the organic unity of governing the Party according to rules and governing the country according to law in the new era.
