摘要
农村宅基地与承包地分属两类不同物质要素,不宜将土地承包经营权的主体制度嵌套于宅基地上,宅基地使用权主体不是农村承包经营户,亦非由流动家庭成员构成的"户"。其初始取得主体是申请时家庭全部集体经济组织成员个人,在共同关系存续期间为各权利人共同共有,待共同关系终结时可以分割份额。宅基地使用权为个人财产,属于继承法所调整的遗产。继承发生于个体的权利人死亡之时,继承人可以就其共有份额进行继承和分割。"一户一宅"原则不构成对继承权的限制。不具有本集体成员身份的继承人可以继承取得宅基地使用权,而非宅基地租赁权。宅基地使用权的继承不以同时继承房屋所有权为条件,继承取得的宅基地使用权亦不以房屋存续期间为期限。
Rural homestead and contracted land belong to two different material elements, so it is not appropriate to nest the subject system of land contractual management right on the homestead.The subject of the use right of the homestead is not the rural contracted management household, nor is it a "household" composed of mobile family members.Its initial subjects are all the collective economic organization members of the family at the time of application.It’s jointly shared by all the rights holders during the existence of the common relationship, and the share could be divided when the common relationship ended.The use right of the homestead is personal property and belongs to the inheritance adjusted by the inheritance law.The inheritance of the use right of the house base occurs at the time of the death of the individual oblige, and the heir may inherit and divide his or her common share.The principle of "one family, one house" does not constitute a restriction on the right of inheritance.The inheritance of the use right of the homestead is not necessary to inherit the ownership of the house at the same time, and the use right is not based on the duration of the house.
