摘要
近年来,区块链技术引起多个领域的广泛关注,不断掀起讨论热潮。在区块链存证如火如荼的发展过程中,立法和司法层面的诸多证据真实性审查方面的问题也逐渐显露,传统电子证据真实性审查模式无法有效适用,司法实践中区块链证据真实性审查乱象纷纭,存在真实性审查未依据不同的区块链证据种类、不同的阶段分别适用不同的审查模式、真实性审查过度极端化、真实性认定的标准和依据存在混乱等问题。本文在总结现有问题的基础上,确立起区块链证据分类型、分阶段、分维度的证据审查新模式。
In recent years,blockchain technology has attracted extensive attention in many fields,and has set off an upsurge of discussion.In the process of the development of blockchain evidence,many problems in the examination of the authenticity of evidence at the legislative and judicial levels have been gradually revealed.The traditional mode of examination of the authenticity of electronic evidence can not be effectively applied,and the authenticity examination of blockchain evidence is chaotic in judicial practice.There are some problems such as the authenticity examination is not based on different types of blockchain evidence,different review modes are applied in different stages,the authenticity review is excessively extreme,and the standards and basis of authenticity identification are confused.On the basis of summarizing the existing problems,this paper establishes a new mode of evidence examination of blockchain evidence,which is divided into types,stages and dimensions.
