摘要
《中华人民共和国民法典》于2021年1月1日起正式施行。“民法典时代”的来临对劳动关系的协调与发展带来重要影响,也为工会聚焦主责主业,进一步发挥维护职能,带来新的机遇与挑战。文章从《民法典》影响劳动关系的基本路径出发,重点围绕《民法典》对劳动关系产生的主要影响进行研究,以期为各级工会组织把握《民法典》施行的契机,进一步实现维护职工合法权益、构建和谐劳动关系提供若干思考和建议。
The Civil Code of the People's Republic of China will come into force on January 1,2021.The advent of the"Civil Code Era"brings important impacts on the coordination and development of labor relations,and also brings new opportunities and challenges for labor unions to focus on their main responsibilities and functions,and further play their maintenance functions.This paper focuses on the main influence of the Civil Code on labor relations,starting from the basic path of the influence of the Civil Code on labor relations,with a view to providing some thoughts and suggestions for trade union organizations at all levels to grasp the opportunity of the implementation of the Civil Code,and further realize the protection of workers'legitimate rights and interests and build harmonious labor relations.
