摘要
2020年新冠肺炎疫情蔓延全球,世界各国纷纷宣布进入紧急状态,政府采取了封城、停工、停课等多项临时性、强制性举措以应对危机,但在实施中出现诸多问题,紧急状态的秩序维持与宪法实施成为学者们关注的焦点。紧急状态理论需建立在宪法框架之下受宪法的约束与规范,方具有正当性与合法性。世界各国宪法文本中大多规定了紧急状态条款,并制定了专门的《紧急状态法》。当前我国的紧急状态制度尚存在一些漏洞和短板,应从修改宪法紧急状态规范、加快紧急状态法律体系构建、加强人大实施监督等方面推进我国紧急状态的宪法实施,以有效应对未来各种突发公共危机。
With the spread of COVID-19 epidemic all over the world in 2020,countries around the world have declared a state of emergency.The government has taken a number of temporary and compulsory measures to deal with the crisis,such as city closure,suspension of work and classes.However,scholars pay more attention to the maintenance and protection of constitutional order under the state of emergency.The theory of emergency should be established under the constitutional framework and be bound and regulated by the constitution in order to have legitimacy and legitimacy.Most of the world’s constitutional texts contain provisions on states of emergency,and a special Emergency Law has been enacted.At present,there are still some loopholes and shortcomings in the emergency system of our country.We should promote the constitutional implementation of the State of Emergency in China from the aspects of revising the norms of constitutional emergency,speeding up the construction of the legal system of emergency,strengthening People’s Congress’supervision of its implementation,so as to effectively deal with all kinds of sudden public crises in the future.
