摘要
"有机农业"这一概念源于西方的农业生产,与我国的生态文明建设理念相合。20世纪90年代以来,我国的有机农业取得长足发展,现已形成比较完善的有机产品认证监督法律体系,并开始出台行政规范化文件对有机农业进行鼓励和扶持。然而,相对于生态文明建设而言,我国的有机农业立法位阶比较低,立法体系和内容总体为消费导向型,关于有机农业的鼓励和扶持还没有统一立法。为了让有机农业更好地服务于生态文明建设,有必要对有机农业立法进行改进:提高立法位阶,协调各方立法力量;增加环境评价要素,实现经济效益、市场效益和环境效益之间的平衡,充分发挥有机认证的评价和监督功能;建立有机农业鼓励和扶持的立法体系。
The concept of organic agriculture,which originated from the western countries,is consistent with the concept of ecological civilization construction both in theory and practice in China.Since the 1990 s,China’s organic agriculture has made great progress,and now it has formed a relatively perfect legal system of organic certification and supervision,and began to issue administrative standardization documents to encourage and support organic agriculture.However,compared with the construction of ecological civilization,China’s organic agriculture legislation ranks relatively low;the legislative system and the overall content are consumption-oriented;organic agriculture on the encouragement and support has not been unified legislation.In order to make organic agriculture better serve the construction of ecological civilization,it is necessary to improve organic agriculture legislation:to raise the legislative rank,to coordinate the legislative forces of all parties;to increase the elements of environmental assessment,to achieve a balance between economic benefits,market benefits and environmental benefits,and to give full play to the evaluation and supervision functions of organic certification;thus establishing encouraging and supporting organic agriculture legislative system.
