摘要
研究目的:国际公地治理关乎全球的可持续发展,也是大国之间利益博弈和竞争的战略制高点。本文旨在剖析国际公地治理存在的现实困境,探讨基于“人类命运共同体”理念的国际公地治理模式与中国参与国际公地治理的政策导向。研究方法:文献研究法、综合分析法。研究结果:针对当前国际公地治理认知不一、主体错位、利益冲突和效果欠佳等现实困境,在国际公地的治理上要坚持文明观、权力观、义利观、秩序观“四位一体”的伦理观,即以兼容并蓄、持续发展的文明观包容不同治理模式,以相互尊重、平等共享的权力观优化治理主体权能,以大国责任、义利兼顾的义利观划分责任与利益,并以规则至上、实事笃行的秩序观制定政策和保障效果。研究结论:在极地、公海、太空和网络空间等国际公地的治理中,中国应在“人类命运共同体”理念的指引下,大力倡导多边治理、持续利用,始终坚持平等互利、合作共赢,着力实现主动作为、共享利益,积极推进衔接规则、引领机制,以此为导向提出和推行国际公地治理的中国方案。
The purposes of this paper are to analyze the problems of global commons governance and to discuss the model of the global commons governance based on Community with Shared Future for Mankind and the policy direction of China’s participation,as the governance of the global commons is a matter of global sustainable development and a strategic high point for the game of interests and competition between major powers.The methods of literature review and comprehensive analysis are applied.The results show that global commons governance is confronted with the realities of different perceptions,misaligned subjects,conflicting interests and poor results.The four-in-one ethic of civility,power,justice and order in the governance of the international commons should be upheld,that is,embracing different modes of governance with a civilizational perspective of inclusiveness and sustainable development and optimizing the rights of governance actors with the concept of mutual respect and equal sharing of rights.The concept of righteousness and benefit,which is the responsibility of a great nation,is used to divide responsibilities and interests.In addition,the concept of order in which rules are paramount and practice requires perseverance,is also used to formulate policies and guarantee their effectiveness.In conclusion,in the governance of global commons such as polar regions,high seas,space and cyberspace,China should under the guidance of the concept of Community with Shared Future for Mankind,vigorously advocate multilateral governance and sustainable use,always adhere to equality and mutual benefit,cooperation and win-win situation,strive to achieve proactive action and share benefits,and actively promote the articulation of rules and create leading mechanisms.Guided by what have mentioned above,the China’s solutions to the governance the global commons can be proposed and promoted.
