摘要
职务发明制度的内部关系调整的是单位与发明人之间的利益分配,无论是“重雇主主义”、“重雇员主义”还是“折中主义”的制度安排都存在一定的弊端,不能妥善解决内部关系中的利益冲突。本文基于洛克的财产权劳动学说和马克思的劳动价值理论分析指出,内部利益难以平衡的主要原因在于现行职务发明制度以权利的天然归属关系掩盖合意转让关系的本质且忽视了技术成果的转化实施。为实现职务发明制度内部利益平衡,本文结合科斯定理和波斯纳定理等理论,相应地提出以追求社会公平为价值目标,兼顾经济效率的解决方案。
The internal relationship of employee invention system adjusts the distribution of interests between the em⁃ployee and the employer.The institutional arrangements of"giving preference to employer","giving preference to em⁃ployee"and"eclecticism"all have some disadvantages and cannot properly resolve the conflicts of interest in internal relationship.Based on the analysis of Locke's Property Theory and Marx's Labor Value Theory,this paper points out that the main reason why internal interests are difficult to balance lies in the fact that the current employee invention system conceals the nature of the consensual transfer relationship with the natural ownership of rights and ignores the transformation and implementation of technological achievements.In order to realize the balance of internal interests of employee inventions,this paper,combined with Coase Theorem and Posner Theorem,proposes the solutions that takes the pursuit of social equity as the value goal and gives consideration to economic efficiency.
