摘要
随着数字数据技术和网络信息技术的快速发展、深度融合及全面覆盖,“两微一端”逐渐成为我国新媒体的主要表征与发声渠道。然而,因新媒体表达环境具有匿名性与任意性,网络用户极易针对特定事件发表虚假偏激言论,特别当新冠肺炎这一重大突发公共安全事件严重刺激公众敏感神经、引发社会恐慌之时,新媒体运行的法治风险被进一步放大,亟待树立正确的舆论理念和治理模式。结合“两微一端”在强化法治互信、健全传播机制、依法拓宽渠道上的强烈诉求,因应分析引入法治模式予以规范的正当性基础与可行性进路,提出从宏观、中观、微观三重维度培育公众舆论信任的法治基石、塑造信息传播公正的法治程序、聚焦媒体技术可靠的法治举措,为依法规范我国新媒体发展提供理论指导与实践方案。
With the rapid development,deep integration and comprehensive coverage of digital data technology and network information technology,the“two micro ends”has gradually become the main representation and voice channel of China's new media.However,due to the anonymity and arbitrariness of the new media expression environment,it is easy for Internet users to make false and extreme comments on specific events,especially when the new coronavirus pneumonia,a major public safety incident,seriously stimulates the public's sensitive nerves and triggers social panic.At that time,the risk of rule of law in the operation of new media was further amplified,and it was urgent to establish a correct public opinion and governance model.Combining the strong demands of the“two micro ends”to strengthen the mutual trust in the rule of law,improve the communication mechanism,and broaden the channels in accordance with the law,according to the analysis of the legitimacy basis and feasibility of introducing the rule of law model to regulate,the three dimensions of macro,meso and micro are proposed Cultivate the cornerstone of the rule of law trusted by public opinion,shape the rule of law for information dissemination justice,focus on reliable legal rule of media technology,and provide theoretical guidance and practical solutions for regulating the development of new media in China according to law.
