摘要
中国传统治理模式中的“人治”、“礼治”、“法治”,在不同的社会时期占据的主导地位不同,对传统社会产生的影响各有差异。现代中国法治建设是对未来的探索,应基于中国的本土资源和传统文化。对中国传统治理模式的分析和价值挖掘,对现代中国法治建设有着重大意义。存续两千多年的“礼治”,久经王朝更迭而不衰,其人本主义思想和追求和谐价值的理念有着至关重要的作用。“人治”与传统法治思想对现代法治建设有一定的警示和启发,权力的监督和制度设计之本土化亦是法治建设不可或缺的要素。
The“rule of man”,“rule of etiquette”and“rule of law”in the traditional Chinese governance model occupy different positions in different social periods and have different effects on traditional society.The construction of the rule of law in modern China is an exploration of the future,which should be based on China's native resources and traditional culture and analyze and mine the traditional Chinese governance model and its value,are of great significance to the construction of the rule of law in modern China.The“rule of etiquette”,which has existed for more than two thousand years,has survived the change of dynasties,and its humanistic ideas and the pursuit of harmonious values have played a vital role.The“rule of man”and traditional thoughts of the rule of law have a certain degree of warning and inspiration for the construction of modern rule of law,and the supervision of power and the localization of system design are also indispensable elements of the construction of the rule of law.
