摘要
由于受规范主义传统与控权理论以及重实体轻程序观念的影响,行政程序被普遍认为是一种控制行政权的工具,导致程序的独立价值与功能长期被忽略而未得到应有的关注与重视。在新时代全面深化改革,着力于推进国家治理现代化而需要积极发挥行政权功能的关键时期,这种试图以行政法和行政程序来控制行政权的理念与理论的根基已经动摇,行政法逐渐转向功能主义。行政法总则当中的行政程序制度设计,应以“求同”为路径和价值目标,既要能维持行政秩序,也要能保持行政活力,还要能回应社会需求。行政法总则中的行政程序来源于单行法,并超越和引领所有的单行法,是适用于包括行政立法、行政执法、行政司法等行政权运行、行政行为实施、监督行政,乃至于制定行政程序规范等所有行政活动的总的程序规范。
Affected by the normative tradition and power control theory,as well as the notion of emphasizing entities and neglecting procedures,administrative procedures are generally regarded as a tool for controlling administrative power.As a result,the independent value and function of the procedures have been ignored for a long time as well as have not received the attention what they deserve.In the new era of comprehensively deepening reforms,the key period of focusing on promoting the modernization of national governance and need to actively exert to the functions of the executive power,the foundation of this idea and theory of trying to control administrative power by administrative law and administrative procedures has been shaken,and administrative law has gradually turned to functionalism.The design of the administrative procedure system in the general provisions of Administrative Law should take“seeking common ground”as the path and value goal,not only to maintain the administrative order,but also to maintain the administrative vitality and to respond to the needs of the society.The administrative procedure in the general provisions of the Administrative Law comes from the single law and goes beyond and leads all the single law.They are applicable to the operation of administrative power,the implementation of administrative acts,and the supervision of administration,including administrative legislation,administrative enforcement of the law,administrative justice,etc.even the establishment of administrative procedures,such as norms of all administrative activities.
