摘要
我国《海洋环境保护法》实施至今将近40年,期间虽然经过若干次修订和修正,但由于形势变化和时代进步,诸多条文仍需要修改,甚至有必要重新审视法律本身的整体结构以及调整对象。本文在回顾国际国内海洋环境保护法律规章以及海洋环境保护领域执法实践的同时,进行横向和纵向比较,大致从七个方面提出了修法的意见和建议。
China’s The Law of Marine Environmental Protection has been implemented for nearly 40 years.Although it has been revised several times during the period,many articles and clauses still need to be revised due to the changes of the situation and the progress of the times.It is even necessary to re-examine the overall structure of the law itself and to adjust the objects in order to be more complete.This paper makes a horizontal and vertical comparison,and puts forward opinions and suggestions on revising the law roughly from the seven aspects by reviewing the practice of international and domestic laws of marine environmental protection and regulations as well as the law enforcement practice in the field of marine environmental protection.
