摘要
大数据在为经济生活发挥作用的同时也带来了数据垄断问题,数据拥有者实施的数据垄断给市场经济的健康发展造成阻碍。数据垄断与传统的垄断不同,数据垄断具有隐蔽性、动态性、易发性等特点,使得现有的法律体系在规制数据垄断时存在许多问题。规制数据垄断的立法不完善、执法力度不严格、责任追究机制不到位是导致数据拥有者对其拥有的数据信息产生垄断的重要因素。应当建立一套科学完善的数据价值评估机制,优化市场支配地位的考虑要素,在建立健全相关立法措施的基础上,加强反垄断执法部门的执法力度,对数据拥有者实施数据垄断的行为进行严厉的打击,为社会主义市场经济的健康运行提供一个良好的营商环境。
Big data not only plays a role in economic life,but also brings about the problem of data monopoly.The data monopoly implemented by data owners hinders the healthy development of market economy.Data monopoly is different from traditional monopoly.Data monopoly has the characteristics of concealment,dynamic and easy occurrence,which makes the existing legal system have many problems in regulating data monopoly.Imperfect legislation,lax enforcement and inadequate accountability mechanism are important factors that lead to the monopoly of data information owned by data owners.We should establish a set of scientific and perfect data value evaluation mechanism,optimize the consideration factors of market dominant position,strengthen the law enforcement of anti-monopoly law enforcement departments on the basis of establishing and improving relevant legislative measures,and severely crack down on the data owners'data monopoly behavior,so as to provide a good business environment for the healthy operation of the socialist market economy.
