摘要
元代水运法的演进呈现与元代社会自身特征相适应的特点。元代"河海共济、海运为主"的漕运格局的形成与水运法规调整之间存在密切关系。漕粮运输方式的选择和漕运路线的变化带来管理机构的不断调整与漕运行政法律制度的完善,大运河法律制度日趋完备,在中国运河法制史上起到承前启后的作用。根据漕运的变化进行专门、有效的水运关系调整,充分体现了法规适时调整的时代性特点。元朝海外贸易非常发达,规范海船运输的"市舶法"周密、细致,体现面向世界的开放性特点。
In the Yuan Dynasty,the water transport law developed in accordance with the social characteristic. The grain transport was starting with the river,followed by the land and the sea,forming a fixed pattern of the river and the sea. Sea is major,river is auxiliary. In the Yuan Dynasty,the river-sea mutual operation and shipping based grain transport pattern was formed,and there was a close relationship between the pattern and the adjustment of water transport law. The choice of grain transportation mode and the change of grain transportation route brought about continuous adjustment of management institutions and the improvement of the legal system of grain transport. The water transport law became more complete,which played a role in inheriting the past in the history of the legal system of Chinese grain transport. According to the changes in grain transport,a special and effective adjustment of water transport relationship was carried out,which fully reflected the characteristic of timely adjustment of regulations. The overseas trade of the Yuan Dynasty was well developed,and the Trade and Shipping Law that regulated the transportation of sea vessels was meticulously made,reflecting the openness to the world.
