摘要
监察委员会和检察院案件流转于监察程序和刑事诉讼程序之间,职务犯罪案件监检衔接仍然面临着诸多挑战。面对提前介入商请函发函率偏低、留置与先行拘留的衔接存在缺陷和退回补充调查制度面临的“两头难”困境等问题,应当通过降低标准增加提前介入商请函发函率,采取“先行移案”方式补充完善先行拘留制度,建立“互相派员式”补充调查制度,完善监检间互相配合、互相制约的工作机制。
The connection between the supervisory committee and the procuratorate in the cases related to duty crimes faces challenges with circulation of cases betweeen the supervisory procedure and the criminal procedure.It is essential to lower the standard to increase the sending rate of earlier intervention invitation letters,to supplement the advanced detention system by adopting the pattern of"advanced transfer",to supplement the investigation system by setting up the pattern of"mutual dispatch of personnel",so as to improve the mutual cooperation and restriction between the supervisory committee and the procuratorate.
