摘要
作为我国维护竞争秩序和优化营商环境的制度保障,公平竞争审查制度当前确立的“内部审查”模式在实践中因为审查机关的能力先天不足、自我审查程序粗糙导致审查易流于形式。由于全面重构公平竞争审查制度的条件在较长时间内难以成熟,可以通过构建政策制定机关激励机制来完善现行的公平竞争“内部审查”模式。在树立正确竞争观念、培育社会竞争文化的前提下,建议为政策制定机关的职能发挥构建自上而下的多方位激励机制,包括建立审查报告公示制度、构建财政激励制度、将竞争审查成效纳入领导干部政绩考核指标体系以及细化公众监督及举报机制。
As an institutional guarantee to maintain the competition order and optimize the business environment in China,the current internal review mode of fair competition review system appears in practice that the ability of review agency is inherently inadequate and self-review procedure is rough,which may easily lead to a dilemma that review is just a formality.Therefore,the current fair competition internal review mode should be perfected through constructing the incentive mechanism of the policy-making agency because of the poor conditions for the comprehensive reconstruction of the fair competition review system.On the premise of establishing a correct concept of competition and cultivating a social competition culture,it is suggested that our country construct a top-down multi-faceted incentive mechanism for the functions of policy-making agencies,including the establishment of a review report publicity system and a fiscal incentive system,the introduction of the effectiveness of competition review to the performance evaluation index system of leading cadres and detailed public supervision and reporting mechanism.
