摘要
真人同人作品,是以现实人物为作品人物原型,以现实为参考进行创作而形成的同人文学作品。真人同人作品是具有可版权性的文学作品,其纪实性内容同样可以纳入著作权保护范围内,适用判断著作权保护范围的普遍标准。但侵犯原型人物姓名权、名誉权等在先权益会造成真人同人作品的著作权瑕疵。是否构成侵权需要结合作品要素、作品发表环境等具体情况来建立灵活的判断标准,而不能简单地一概而论。
The doujins(collaborative content creations)are fan literature works based on real characters as the prototypes of the works and created based on reality.The works of real fandom are copyrightable literary works,and their documentary content can also be included in the scope of copyright protection,and the universal standards for judging the scope of copyright protection shall be applied.However,infringement of the prior rights and interests such as the name rights and reputation rights of the prototype characters will cause the copyright defects of the works of the real fan.At the same time,whether it constitutes infringement needs to be combined with the elements of the work and the specific circumstances of the work to establish a flexible judgment standard,and cannot be simply generalized.
