摘要
[目的]分析四川省医疗损害责任纠纷的现状,探讨其起因、赔偿特点及防控策略。[方法]以中国裁判文书网所公布的四川省2018年1月1日-2019年12月31日的医疗损害责任纠纷文书中符合纳入标准的183例判决文书为研究对象,提取案件关键信息进行统计分析。[结果]三级医院(46.4%)的案件多于一级(7.7%)、二级医院(29.0%);从纠纷案件发生科室来看,排名前三的科室分别是外科(58.5%)、妇产科(21.3%)、内科(8.2%),73.8%的案件起因是手术(39.3%)、治疗(21.9%)和诊断(12.6%)。不同损害结局案件的索赔金额和实赔金额差异均有统计学意义(P <0.01),损害结局为一级伤残到三级伤残的索赔和实赔金额最高。[结论]四川省医疗损害责任纠纷案件在不同市(州)、不同医院等级和科室间分布不均衡;案件索赔金额与实赔金额相差悬殊;医院责任和损害结局与赔偿金额密切相关。
Objective To analyze the status of medical damage liability disputes in Sichuan Province, and discuss its causes, compensation characteristics and prevention and control strategies. Methods It studied 183 judgment documents of medical damage liability disputes documents which were published in "China Judgement Document Net" from Jan. 1, 2018 to Dec. 31,2019 in Sichuan Province, key information of cases were extracted and analyzed. Results There were more cases in tertiary hospitals(46.4%)than that in top(7.7%)and second level hospitals(29.0%).From the view of disputes in department, the front three departments were surgery department( 58.5%), gynaecology and obstetrics department(21.3%),and medial department(8.2%). 73.8% disputes were caused by surgery(39.3%), treatment(21.9%)and diagnosis(12.6%). There was statistical significance in difference between claims and actual amount of different damage cases(P0.01), claims and actual amount of first level to third level disability were the highest. Conclusions Medical damage liability disputes in Sichuan Province are unevenly distributed in different cities, different level hospitals and departments. The difference of amount of claims and actual amount of is great. Hospital liability and damage are closely related to amount of compensation.
