摘要
博物馆文创产业是以博物馆历史文化资源为基础、以创作者创造性思维为核心竞争力、与知识产权保护密切相关的新兴产业。博物馆文创的核心灵感来源于馆藏文物。博物馆文创是一个继承之中有发展、发展之中有历史的"有中生新"的创新过程,体现着对历史的尊重和文化的传承,并在传承中创新。当前,博物馆亟需应对文创运营中的观念错误,理解文创经营、公益属性和知识产权私益保护之间的关系,通过对文物要素的提炼、挖掘和创造,将历史文化传承与创新相结合,进行二次开发以获得知识产权。博物馆在文创产品开发和运营中,要跳出单一的版权思维,从著作权、专利、商标、商业秘密、域名等多元的知识产权路径寻求对文化创意成果的保护。
The cultural and creative industry of museums is an emerging industry that is based on the museum’s historical and cultural resources and closely related to intellectual property protection;creative thinking is its core competitiveness. With the museum’s collection as its greatest inspiration, cultural creation in museums is a creative process that inherits and develops combining history and innovation. It reflects the respect for history and the inheritance of culture. Museums urgently need to deal with conceptual mistakes in cultural and creative operations, understand the relationship between cultural and creative operations, nonprofit attribute, and the protection of intellectual property rights, and obtain intellectual property rights through the extraction, mining and creation of cultural relics elements. In the development and operation of cultural and creative products, museums need to go beyond the single copyright thinking to seek protection of cultural and creative achievements from multiple intellectual property paths such as copyrights, patents,trademarks, trade secrets, and domain names.
