摘要
在FIDIC施工合同条件下,通过对价调公式中的三要素——调价项目、权重系数、价格指数的合理安排,可以较为公正地分摊业主和承包商所承担的市场价格涨跌风险。在业主原因导致工期延期的条件下,结合工程实例,从承包商角度对调价公式中的三要素以及汇率影响因子进行研究,以期对承包商投标、协议谈判时合理安排价调公式提供指导,规避风险、控制成本、增加收益。
Under FIDIC conditions of contract for construction, the risk of fluctuations in market prices borne by the owner and the contractor can be fairly allocated through a reasonable arrangement of three elements in price adjustment formula, i.e. price adjustment items, weight coefficient and price index. In the context of construction period being delayed due to the owner, this paper studies reasonable arrangement of three elements in the price adjustment formula and influence factors of exchange rate from the perspective of the Contractor through the case study, aiming at providing guidance for the contractor to make reasonable arrangement of price adjustment formula during bidding and agreement negotiation for better risk mitigation, cost reduction and revenue increase.
