摘要
二次供水设施的卫生许可依据,在《生活饮用水卫生监督管理办法》颁布之初就没有获得合法地位,尽管目前仍有不少地区还将其纳入卫生行政许可范畴,但在国家大力提倡简政放权和行政审批制度改革的政策大环境下,纠结于许可思维已不现实,如何做好事中事后监管才是当前急需考虑的问题。本文通过对一起二次供水设施污染导致生活饮用水不符合卫生标准行政处罚案例进行分析,作者从被处罚主体认定、违法事实取证、法律法规适用、水质检测结果的合法性等几个方面进行了分析。探讨如何正确运用饮用水法律法规进行卫生行政处罚,加大二次供水的监管力度,杜绝饮用水卫生事件的发生,切实保证饮用者的卫生安全。
The sanitary permit basis for secondary water supply facilities did not obtain legal status when the Measures for the Supervision and Administration of Sanitary Drinking Water was promulgated.Although many regions still include it in the scope of sanitary administrative permits,it has been vigorously implemented In the context of a policy environment that advocates simplified administration and decentralization and the reform of the administrative approval system,it is no longer realistic to be perplexed by the thinking of permission.How to do good after-the-fact supervision is an urgent issue at present.This article analyzes a case of administrative punishment for drinking water that does not meet sanitary standards due to pollution from secondary water supply facilities.The author conducted several aspects such as the determination of the punished subject,evidence collection of illegal facts,application of laws and regulations,and the legality of water quality test results.analysis.Explore how to properly use drinking water laws and regulations for sanitation administrative punishment,strengthen the supervision of secondary water supply,prevent the occurrence of drinking water hygiene incidents,and effectively ensure the health and safety of drinkers.
