摘要
本文分析了中国化学和生物创新药上市后有效专利期,发现化学创新药的有效专利期只有9.7年,建议优先对化学创新药的专利期限进行补偿。以化学创新药为研究对象,借鉴美国、欧洲的专利期限补偿期的计算方式,本文模拟计算现有创新药进行补偿后的总有效专利期,建议补偿期的计算方式应当采用美国计算法。
This paper analyzes the effective patent life of Chinese innovative drugs including chemical and biological innovations.It is found that the effective patent life of the chemical innovative drug is only 9.7 years,suggesting that chemical drug innovation patent term should be extended first.Taking innovation in chemical drugs as the research object,learning experience from the United States and Europe,this paper estimates the total effective patent life of current innovation drug.This paper suggests calculation method of patent term extension time should be American model.
