摘要
与法律的国家性、中国法治的国家主义、国家法学等相似,法治文化可能同样具有特定的国家性,可进一步提炼为国家法治文化概念。国家性主体是国家治理中的主导,国家治理语境下必须重视国家法治文化的培育。国家法治文化是一种制度文化、政治文化和上层文化,并与社会法治文化、个体法治文化等相区分,具有鲜明的国家性、最强的公共性和国家层面上的总体性和系统性。国家法治文化和现今中国的国家属性紧密相连,核心的方面即是表现为社会主义核心价值观融入到国家法治文化的培育和建设当中。国家法治文化的提出对于更为清晰地认知整体的法治文化,现实地推行我国法治文化建设等方面意义重大。
Similar to the national law,the nationalism of Chinese rule of law,and national jurisprudence,the culture of rule of law may also have a specific nation characteristic,which can be further refined into the concept of national culture of rule of law.The national culture of rule of law is a kind of system culture,political culture and upper culture,which is distinguished from social legal culture and individual legal culture.It has distinct national character,strong public character,and overall and systematic character at the national level.The national culture of rule of law is closely connected with the national attribute of China,and the core aspect is that the socialist core values are integrated into the cultivation and construction of the national culture of rule of law.It is of great significance to understand the whole rule of law culture more clearly and to carry out the construction of our rule of law culture realistically.
