摘要
我国行政诉讼法上之"诉讼不停止执行"的例外规定与诉前保全,被普遍认为是我国现行的行政预防性保护制度,但其救济权利的作用十分有限。为能更充分地保障合法权益,就十分有必要建构行政行为执行力的诉前阻断机制。该建构制度应坚持效益性、事项限制性与程序性监督三项原则,并应严格限定提起阻断申请的主体资格。诉前阻断行政行为的执行力,并不能产生终局性效果。如果行政机关认为,阻断行政行为的执行力会对国家利益或者公共利益造成重大影响,可向有关人民法院申请紧急解除,而如果确有错误的,则可通过司法建议、司法调解等方式予以解决。诉前阻断程序的经过时限以后,行政行为的执行力自行恢复,并应继续执行。
The exceptions and security prelitigation in"not stopping executing agency action"prescribed by the Law of Administrative Procedure of PRC are generally considered as an administrative protecting system,but its relief function is limited.In order to sufficiently safeguard legal interests,it is necessary to construct a pre-pleading blocking mechanism in which the administrative act functions as the executive force.When constructing this system,the principles of effectiveness,restrictiveness and procedural supervision.Moreover,the right as principal shall be strictly prescribed.The executive force of administrative act is not decisive.If the administrative organ believes that the executive force of administrative act will bring great damage to the interests of the state or the public,then it can apply to the court for urgent rescission.If mistakes really occur,they can be resolved by judicial suggestions or judicial conciliation.When the limitation period of pre-pleading blocking mechanism ends,the executive force of administrative act can be automatically resumed and be carried on again.
