摘要
目的:苗药是我国特有的优势产业资源,是我国拥有自主知识产权的优势领域,然而目前我国苗药知识产权保护力度与其资源开发相比相对滞后,本文基于产业链的视角分析我国苗药专利保护现状,以期为苗药的专利保护提供策略。方法:本文以Incopat科技创新平台专利数据库为数据源,从产业链的视角对苗药专利文献进行深入分析,从国内苗药专利技术生长曲线、法律状态、主要申请人及产业链下的专利技术分布情况等多方面阐述了当前苗药专利发展现状。结果:分析结果显示,苗药专利申请数量不足且质量较低,专利申请水平亟待提高;苗药专利申请以企业和个人为主,高校院所申请占比较低;苗药专利申请呈现高度区域性分布特点,除贵州外大部分苗药产区还尚未形成苗药专利保护的意识;苗药上游产业链专利保护十分薄弱,下游产业链中对苗药提取物及有效部位的相关专利保护不足,尚未形成全产业链及全方位的专利保护格局。结论:要加强苗药各产区知识产权保护宣传及区域间合作力度;加大高校等科研单位对苗药科技开发重视程度;加强产业链薄弱环节的专利申请,并利用地理标志、商标等多种手段,最终形成全产业链及全方位的苗药知识产权保护策略。
Objective:Miao medicine is a unique superior industrial resource and an advantageous field with independent intellectual property rights in China.However,the current protection of intellectual property rights of Miao medicine in China is relatively backward compared with the development of its resource.This paper analyzed the current situation of patent protection of Miao medicine in China from the perspective of industrial chain,so as to provide strategies for patent protection of Miao medicine.Method:This article used the patent database of Incopat Technology Innovation Platform as the data source to conduct an in-depth analysis of the patent literature of Miao medicine from the perspective of the industry chain.The current development status of Miao medicine patent was expounded from the growth curve,legal status,and main applicants of domestic Miao medicine patent technology and the patent technology distribution under the industry chain.Result:The analysis results showed that the number of patent applications of Miao medicine was insufficient and the quality was low,and the level of patent applications needed to be improved urgently.The patent applications of Miao medicine were dominated by enterprises and individuals,and the proportion of applications from colleges were relatively low.The patent applications of Miao medicine were highly regional distributed.Except for Guizhou,most of the Miao medicine production areas had not yet formed the awareness of patent protection of Miao medicine.The patent protection of the upstream industry chain of Miao medicine was very weak,and the related patent protection of Miao medicine extracts and effective parts in the downstream industry chain was insufficient.The whole industry chain and all-round patent protection pattern had not been formed yet.Conclusion:It is necessary to strengthen the IPR protection promotion and interregional cooperation in the production areas of Miao medicine.The importance of technology development of Miao medicine should be attached to the s
