摘要
我国现行植物新品种保护制度所构建的是以繁殖材料的控制和利用为内容的品种权保护体系.繁殖材料不仅是品种权保护实践的核心范畴,同时也是品种权保护对象初始形式的物质载体.授予品种权人控制和利用繁殖材料的垄断性权利,盖因为繁殖材料是品种商业化应用的前提,是侵犯品种权行为的起点和源头.对繁殖材料的控制是实现品种权的手段,繁殖材料本身不足以界定品种权的保护范围,繁殖材料是且只是品种权的保护对象的物质表现形式之一而已.保护范围是受品种权人控制的自由行为的边界,保护对象是品种权的物质载体.最高人民法院民终14号判决将繁殖材料定性为品种权的保护范围,从理论上讲混淆了保护对象和保护范围的概念,从实践上讲限缩了品种权的保护范围.
The current protection system of new plant varieties in China has established a variety rightsprotection system based on the control and utilization of breeding materials.The breeding materials are notonly the core category of the practice of variety rights protection,but also the material carrier of the initialform of the object of variety rights protection.The owner of the variety rights is granted the monopolyright to control and use the breeding materials,because the breeding materials are the premise of thecommercial application of the breed and the starting point and source of the violation of the breed right.The control of breeding material is the means of the variety rights realization.The breeding materialsthemselves are not enough to define the protection scope of the variety rights and the breeding materialsare the only one material forms of the protection object of the variety rights.The scope of protection is theboundary of the free behavior controlled by the variety rights holder,and the object of protection is thematerial carrier of the variety rights.The Supreme People's Court Final Civil Judgment No.14 definedbreeding material as the protection scope of variety rights,which in theory confuses the concepts ofprotection objects and scope of protection theoretically,and in practice limits the protection scope ofvariety rights.
