摘要
疾病预防控制机构在突发公共卫生事件应对中具有重要作用,但在新冠肺炎疫情防控过程中,其应急法律机制显现出诸多弊端。当前,疾病预防控制机构存在法定权限过小、某些职责与其定位不相匹配、各级疾病预防控制机构的管理机制不科学、法定职责履行能力不足等问题。为更有效地发挥疾病预防控制机构在突发公共卫生事件应对中的作用,应当重构疾病预防控制机构的管理体制、扩大疾病预防控制机构的应急权限、提升疾病预防控制机构的应急能力,对应急法律机制进行完善。
Agencies for disease control and prevention have an important role in responding to public health emergencies,but in the process of prevention and control of COVID-19,the emergency management system has exposed many problems.At present,agencies for disease control and prevention have such problems as too small statutory authority,mismatch of certain duties and their positioning,unscientific management mechanisms of disease prevention and control institutions at all levels,and insufficient capacity to perform legal duties.In order to more effectively play the role of agencies for disease control and prevention in responding to public health emergencies,the emergency management system of agencies for disease control and prevention should be improved in terms of restructuring institutional mechanisms,expanding emergency authority,and enhancing emergency capabilities.
