摘要
我国公平竞争审查制度在制度设计上存在一定程度的“路径依赖”,即自我审查模式深陷动机悖论与能力悖论的双重“诘难”。针对于此,需要建构我国公平竞争审查的激励机制。对于政策制定部门而言,财政奖励与补助以及在政府人员考核中引入激励机制是解决动机悖论的有效路径;开展实务培训与建立自我审查的审核制是化解能力悖论的有效方式。
The existing regime reflects a certain degree of“path dependency”,where the self-examination model swamps a dilemma of willingness and ability paradox.In this regard,a long term incentive mechanism needs to be established.For policy making authorities,the introducing of financial incentives such as subsidies along with personnel appraisal incentives would be effective solutions to motivation paradox,while carrying out practice training and setting up self-examination system the useful approaches to solve the ability paradox.
