摘要
法治国家权力运行的正当化基础在于保护公民私权。但侦查权在运行中常出现与公民私权冲突的现象:不当扩大侦查权适用范围、以刑事手段插手经济纠纷、滥用刑事强制措施和手段。之所以出现这种现象是因为警察对自身的角色认知与公民对侦查权的角色预期出现了矛盾。为规范侦查权行使,需要合理限制其适用范围、严格控制立案标准、慎重使用刑事强制措施。
The legitimate basis for the operation of state power under the rule of law is to protect the private rights of citizens.However,in the process of operation,the investigation power often conflicts with citizens private rights,such as improperly expanding the scope of application of the investigation power,meddling in economic disputes by criminal means,and abusing criminal coercive measures and means.The reason is the contradiction between the police s cognition of their roles and the citizens expectation of the right to investigate.In order to regulate the exercise of the investigation right,it is necessary to limit its scope of application reasonably,control the standard of filing a case,and use compulsory criminal measures prudently.
