摘要
监察建议作为监察机关践行监察权的方式,是监察体制改革与监察全覆盖深入推进的重要体现。监察对象和监察事项的非特定性决定了监察建议的类型及其内容具有广泛性,需要结合监察法规定的不同场合予以区别使用。基于监察机关作为监察专责机关的基本立场,监察建议应聚焦于廉政建设与正当履职的功能定位,并在具体使用中与单位的廉政自治权保持一定的距离。监察建议应保证提出主体的依法行使,在建议内容上实现具体与抽象的协调性,注重监察建议实践运行的闭环路径,合理构建监察建议提出之后的救济机制,有益促进监察建议在监察实践中的规范有序运行。
As a practical way for supervision organs to exercise their supervision power,supervision suggestions are an important embodiment of the deepening of the reform of supervision system and the full coverage of supervision.Due to the non-specific nature of the supervision object and matters,the types and contents of the supervision suggestions are extensive,which need to be used in different situations according to the supervision law.Based on the basic position of the supervisory organ as a specialized supervision agency,the supervision suggestions should focus on the function orientation to clean government construction and proper performance of duties,and keep a certain distance from the governmental unit's anti-corruption autonomy in specific use.Supervision suggestions should ensure that the main body of supervision is exercised in accordance with the law,embody the coordination of the concrete and the abstract in the content of the suggestions,pay attention to the construction of a closed-loop path of the practical operation of the supervision suggestions,reasonably construct relief mechanism after the proposal of supervision,and promote the standardized and orderly operation of the supervision suggestions in the supervision practice.
